I think the bottom line here is that what is being provided is copyrighted
software and the individual in question apparently does not have the
permission of the current copyright holder to distribute it.

Good intentions do not make something legal. Old obsolete versions are one
thing but 3.1 is currently being sold in various forms.

One other thing, just because the owner of the software doesn't choose to
make it available for what ever reason does not give someone the right to
distribute it 'just because someone might need a copy'.
